Roster Terms of Service

1. Acceptance of Terms

By accessing or using the Application, you affirm that you are at least 18 years old and capable of entering into a binding legal agreement. If you are under 18, you may not use the Application.

2. Changes to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via email or in-app notifications. Your continued use of the Application after such changes constitutes your acceptance of the updated Terms.

3. Use of the Application

3.1 License

We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Application for personal, non-commercial purposes. You agree not to:

1. Copy, modify, or distribute the Application or any of its content without prior written consent.
2. Reverse-engineer, decompile, or disassemble the Application.
3. Use the Application for illegal purposes or in violation of any laws.

3.2 User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account.

4. User-Generated Content

The Application allows you to log information, such as date details and notes ("User Content"). You retain ownership of your User Content but grant us a non-exclusive, royalty-free, worldwide license to use, store, and display your User Content solely to operate the Application.

4.1 Restrictions

You agree not to upload, post, or share User Content that:

1. Contains offensive, defamatory, or unlawful material.
2. Violates intellectual property rights or privacy rights of others.
3. Harms or exploits minors in any way.

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

5. Payments

5.1 Payment Terms

Certain features of the Application may require payment. All payments are processed securely through the App Store. By making a payment, you agree to comply with the App Store’s payment terms and policies.

5.2 Refund Policy

Refund requests are subject to the App Store’s policies. If you believe you are eligible for a refund, please contact the App Store directly to initiate the request. We do not process refunds directly.

6. Privacy

Your use of the Application is subject to our Privacy Policy. By using the Application, you consent to the collection, use, and sharing of information as described in the Privacy Policy.

7. Prohibited Activities

You agree not to:

1. Use the Application in a way that violates applicable laws or regulations.
2. Interfere with or disrupt the Application’s functionality.
3. Attempt to gain unauthorized access to other users’ accounts or our systems.
4. Introduce viruses or other malicious code into the Application.

8. Intellectual Property

All intellectual property rights in the Application and its content (excluding User Content) are owned by Get Convey Inc. or its licensors. You may not use our trademarks, logos, or other proprietary materials without our written consent.

9. Disclaimer of Warranties

The Application is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the accuracy, reliability, or availability of the Application.

10. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for:

1. Indirect, incidental, special, or consequential damages arising from your use of the Application.
2. Any loss of data, profits, or goodwill.

Our total liability for any claims related to the Application will not exceed the amount you paid to use the Application in the 12 months prior to the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Sincerely Studios Inc., its affiliates, and their officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the Application or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the Application at our sole discretion, without notice, for any reason, including violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles. Any disputes arising under these Terms will be resolved exclusively in the state or federal courts located in California.
